Where is smoking tobacco prohibited in West Hollywood?
- Within five (5) feet of outdoor dining and outdoor service areas such as ATM lines, information kiosks, entrances to venues or theaters, vehicle service establishments, or valet areas
- Enclosed public places
- Public Parks and Parklets
- In common areas and in new units of multi-family dwellings
- Areas prohibited under state or federal law
How do I report an individual or business if I suspect they are violating the tobacco retailer or smoking ordinances?

What are the requirements for my business regarding outdoor smoking and non-smoking areas?
- If your business has an open air dining area or outdoor service area where smoking will be prohibited, you must post permanent no smoking signs. The Municipal Code strictly regulates the size, display, and location of no smoking signs. Please click here for more details.
- You may be required to submit a Smoking Operation Plan.
- Businesses are required to enforce the smoking ordinance in areas that prohibit smoking (5 ft from outdoor dining or service areas
What is a Smoking Operation Plan?
A Smoking Operation Plan is a proposal submitted to the Planning Department that outlines areas of your establishment where smoking will take place as allowed under the ordinance. Any business that will continue to allow smoking must submit a plan.
What are the penalties for non-compliance?
The City monitors businesses that receive frequent complaints (i.e., no signage posted; ashtrays on tables; or documentation that employees are not warning people that smoking is prohibited) and cite violators as necessary.
A violation of this Chapter shall be subject to the administrative penalty provisions of Sections 1.08.030 through 1.08.070 of the West Hollywood Municipal Code.
