How To Contest An Administrative Citation
Administrative citations are issued by the City’s Neighborhood and Business Safety Division (Code Enforcement) or Los Angeles County Sheriff’s Department for violations of the West Hollywood Municipal Code. Most administrative citation numbers begin with the letters “AC” or “CV”. The procedures for the issuance and challenge of administrative citations are prescribed by West Hollywood Municipal Code chapter 1.08. (http://qcode.us/codes/westhollywood/)
Administrative citations can be appealed provided that the Request for Administrative Hearing is received by the City within 21 days from the date the citation was issued, or if mailed to the City, is postmarked no later than the 21st day after the date the citation was issued. The request shall be accompanied by a deposit in the full amount of the penalty, inclusive of the administrative reimbursement portion, or written proof of financial hardship, which at a minimum must include tax returns, financial statements, bank account records, salary records or similar documentation demonstrating that the responsible party is unable to deposit the penalty. Requests received or postmarked after the time to appeal has expired, or without payment or acceptable proof of financial hardship, will be rejected, and no hearing will be scheduled.
Options to file an appeal:
- Fully complete the Request for Administrative Hearing and Statement of Rights and Responsibilities and mail, along with a check or money order in the full amount of the penalty to City of West Hollywood, Neighborhood and Business Safety Division, 8300 Santa Monica Blvd., West Hollywood, CA 90069; or
- Pay the full amount of the penalty through the City’s Online Payment Portal and choose “Administrative Citation Appeal” at https://heartlandpaymentservices.net/WebPayments/WEHOOnlinePaymentsFees/bills.After you have paid, fully complete the Request for Administrative Hearing and Statement of Rights and Responsibilities and email those forms, along with a copy of the payment receipt that was emailed to you, to code@weho.org; or
- If you are unable to pay the full amount of the penalty, you may request a waiver of the deposit.To do so, fully complete and submit the Request for Waiver of Deposit, along with supporting documentation, Request for Administrative Hearing and Statement of Rights and Responsibilities either by mail or email as described above.Note that submission of the Request for Waiver of Deposit is not a guarantee that your request will be granted.
Upon receipt of a timely and complete appeal request, a hearing will be scheduled. You will receive a notice by mail stating the date, time and location of the hearing. (Note: All hearings will be conducted remotely via the Microsoft Teams platform.)
If following receipt of the notice of hearing, you have a conflict that will prevent you from attending the hearing at the date and time stated in the notice, complete the Rescheduling Request and return it to code@weho.org no later than 3 business days before the scheduled hearing date. Absent proof of emergency, a hearing will only be rescheduled once.
In lieu of attending the hearing, you may make an appearance by Written Declaration. If you choose to do so, you must fully complete and submit the Written Declaration form, along with any supporting documentation, to the City no later than the date and time indicated on your notice of hearing.
If you do not wish to contest the citation but are unable to pay the penalty in full, a payment installment plan of up to one year is available to qualified applicants. Complete and submit the form here, along with any supporting documentation to code@weho.org, and you will be contacted by a staff member in 7-10 days. Note that submission of a request does not guarantee approval of a payment installment plan.
