CA Housing Crisis Act
- California’s Housing Crisis Act (HCA) (Government Code Section 66300 et seq.) requires that any proposed housing development project replace all existing protected units or protected units demolished on or after January 1, 2020.
- Tenants in protected units under the HCA are entitled to the following protections under State Law:
- the right to remain in the unit for 6 months prior to the start of construction activity;
- written notice of the planned demolition that includes vacate date and their rights;
- the right to return/right of first refusal for eligible tenants;
- the right to return if the demolition does not proceed; and
- the right to relocation benefits for eligible tenants.

- LA County Establishing Maximum Temperature Thresholds
- In January 2024, the Los Angeles County Board of Supervisors passed a motion directing the Department of Public Health to collaborate with other County departments to establish a Safe Maximum Temperature Threshold for Residential Units, gather stakeholder input, and prepare a draft ordinance.
- Attend an Upcoming Stakeholder Meeting: The Los Angeles County Department of Public Health will host virtual stakeholder meetings to present the status of the County ordinance and gather input from stakeholders.

AB1620: New Unit Swapping Regulations
- Assembly Bill (AB) 1620, effective January 1, 2024, authorizes local jurisdictions that have opted into this new legislation to require that tenants in rent-controlled units and who have permanent physical disabilities related to mobility be allowed to relocate to an available, accessible unit at the same rental rates and terms of the existing lease. This law only applies to properties with five or more rental units
- This law allows local jurisdictions that have enacted rent control ordinances to permit a tenant to maintain the same rent if they make a request to the landlord to move to a comparable or smaller unit in the same building due to a permanent disability related to mobility.
- The law provides that the move is allowed if all of the following apply:
- 1) the move is determined to be necessary to accommodate the tenant’s physical disability related to mobility;
- 2) there is no operational elevator that serves the floor of the tenant’s current unit;
- 3) the new unit is in the same building or on the same parcel with at least four other units and shares the same owner;
- 4) the new unit does not require renovation to comply with applicable requirements of the Health and Safety Code; and
- 5) the tenant is not currently subject to an eviction for non-payment of rent.
- Tenants can utilize this new law by requesting an accommodation in writing to their landlord. For further questions or information, please contact the Rent Stabilization Division at (323) 848-6450.

Know the Rules Before you Rent! |
West Hollywood administers rent stabilization and tenant protections through the Rent Stabilization Ordinance (RSO) and Rent Regulations.
The RSO requires landlords to register new tenancies within 30 days after the tenancy begins for buildings built on or before July 1, 1979 (West Hollywood Municipal Code §17.28.040). Now this process can be quickly and easily completed through our Online Landlord Service portal.
Tenant Protections Apply to all Rentals
The West Hollywood RSO (Rent Stabilization Ordinance) provides tenant protections regardless of when the building was built.
Tenants in West Hollywood can only be evicted for certain reasons, such as not paying rent, or causing a nuisance. (WHMC 17.52) | ||
Landlords are required to pay relocation fees to tenants displaced through a no-fault eviction. | ||
Landlords are prohibited from engaging in harassment of a tenant in a manner that would cause a reasonable tenant to vacate their dwelling unit, | ||

Buildings Built Before July 2, 1979: Rent Stabilization Program Rent Increase Limits, Maintenance Requirements
Buildings receiving a certificate of occupancy before July 1, 1979 are subject to the full RSO including:

Following the first 12 months after a tenant moves in, the property owner may increase rent but only to the limit allowed by the Annual General Adjustment (AGA). | |
