The City of West Hollywood is getting the word out that the Los Angeles County Board of Supervisors has again extended renter protections for residential tenants due to the countywide surge in COVID-19, influenza, and RSV cases. The County’s Tenant Protection Resolution was set to expire on January 31, 2022 but has been extended until March 31, 2023.
Protection against the following grounds for eviction may be raised as an affirmative defense by tenants:
- Non-payment of rent due between July 1, 2022 and March 31, 2023 due to a COVID-19 financial hardship, only for tenant households with income at or below 80% of the Area Median Income (AMI);
- No-Fault eviction reasons (except for qualified Owner Move-in);
- Nuisance; and
- Unauthorized occupants or pets whose presence is necessitated by COVID-19.
A Residential Tenant whose household income is at or below 80 percent AMI and was unable to pay rent incurred from July 1, 2022 through March 31, 2023 shall have up to twelve (12) months thereafter to repay such rental debt. Further, the existing no-fault eviction protection shall remain in effect during the tenant’s repayment period.
